DMCA Takedown Procedure

1. COPYRIGHT & INTELLECTUAL PROPERTY

Ahlan respects the intellectual property rights of others. The Digital Millennium Copyright Act (DMCA) provides a legal mechanism for copyright owners to request removal of infringing content.

2. TAKEDOWN NOTICE REQUIREMENTS

A valid DMCA notice must include:

  1. Your Physical Signature (or electronic signature)
  2. Identification: Your name, address, phone, email
  3. Copyright Owner Info: If filing on behalf of someone else, include their info and authorization
  4. Copyrighted Work Description: What work(s) are allegedly infringed
  5. Infringing Material Description: Specific location of allegedly infringing content
  6. Infringement Assertion: Statement that you believe use is not authorized
  7. Good Faith Statement: Statement that the notice is accurate and made under penalty of perjury
  8. Contact Information: Email and phone for correspondence

3. HOW TO SUBMIT TAKEDOWN NOTICE

Submit DMCA notices to:

Include complete notice with all required elements above

4. PROCESSING TAKEDOWN NOTICES

  • Receipt Confirmation: Within 24 hours of receiving notice
  • Verification: Ahlan verifies notice completeness and validity
  • Incomplete Notices: Requestor notified of deficiencies, given opportunity to cure
  • Valid Notice: Infringing content removed within 24-48 hours
  • User Notification: User informed of removal and provided appeal instructions

5. USER COUNTER-NOTICE

Users who believe content was removed in error may file a counter-notice including:

  • Physical or electronic signature
  • Name, address, phone, email
  • Identification of removed content
  • Statement that removal was in error or mistaken identity
  • Statement consenting to federal court jurisdiction
  • Good faith declaration under penalty of perjury

6. COUNTER-NOTICE PROCESS

  1. Submit: Send counter-notice to dmca@ahlan.app
  2. Acknowledgment: Ahlan acknowledges receipt within 24 hours
  3. Forward: Ahlan forwards counter-notice to original claimant
  4. Waiting Period: 10-14 business day waiting period
  5. Reactivation: Content restored unless claimant files court action

7. REPEAT INFRINGEMENT POLICY

  • First valid DMCA notice: Warning issued
  • Second valid notice: 7-day account suspension
  • Third valid notice: 30-day account suspension
  • Fourth valid notice: Permanent account termination, no refund
  • Pattern of abuse: Account may be terminated immediately

8. TRADEMARK & OTHER IP

For trademark, patent, or other IP infringement:

  • Email: legal@ahlan.app with subject "IP Infringement Notice"
  • Include same information as DMCA notice (adapted for IP type)
  • Ahlan will investigate and respond within 5-7 business days
  • Non-DMCA notices handled under contract and legal review

9. FALSE CLAIMS LIABILITY

Filing a false DMCA notice can result in:

  • Civil liability under 17 U.S.C. § 512(f)
  • Damages including lost profits and attorney fees
  • Criminal perjury charges (filing under penalty of perjury)
  • Ahlan may report false notices to law enforcement

10. FAIR USE CONSIDERATIONS

Ahlan respects fair use rights including:

  • Commentary and criticism of copyrighted works
  • News reporting and teaching
  • Parody and transformative use
  • Educational use in limited quantity

Before filing a takedown, ensure the use is not protected by fair use.

11. RESTORATION OF CONTENT

Content may be restored if:

  • Counter-notice received and verified
  • Claimant does not file court action within 10-14 days
  • Original claimant requests restoration
  • Ahlan determines notice was invalid or incomplete

12. NOTICE HISTORY

  • Ahlan maintains records of all DMCA notices received
  • Users can request their notice history
  • Records retained for minimum 3 years
  • Records available upon valid legal request
